JOB SUMMARY: The Assistant Attorney, under the direction of the Attorney General, will be tasked with the responsibility of prosecuting crime on the Tribe’s Reservation, handling juvenile and traffic court matters, and will work closely with Tribal Police and other local state and federal agencies to fulfill the position’s obligations. The attorney will also assist the Attorney General with other assigned matters regarding the representation of the Tribe, its Housing Department, its Tribal Health Department, and compliance for its tribally owned businesses, including but not limited to the Royal River Casino and Hotel, Native Nations Cannabis, and 605 Lending.

ESSENTIAL DUTIES AND RESPONSIBILITIES:

  • The Assistant Attorney shall perform legal services as requested by the Tribe as Assistant Attorney General. The duties required of the Assistant Attorney shall be subject to the supervision and direction of the Attorney General.

  • The Assistant Attorney shall only act on such matters as specifically aimed at acting upon either by resolution or direction of the Executive Committee. Said legal services shall include attendance at meetings, advice on legal and policy matters, assertion of any valid claims through appropriate legal proceedings, preparation and review of legal documents, assistance in negotiation, preparation, and execution of any settlement agreements, representation before appropriate agencies, tribunals, and legislative bodies, and other legal matters as may be specified by the Executive Committee.

  • Represent the Tribe as a Prosecutor and Child Welfare Attorney in Tribal Court to enforce criminal laws, child welfare laws, and related tribal court orders.

  • Appear in court on all related arraignments, trials, sentence hearings, and child welfare matters.

  • Engage in or lead pretrial investigations.

  • Train, assist, and advise the Tribal Police in the prosecution of criminal cases, and the preparation and execution of requests for arrest and search warrants (where relevant, train other tribal staff regarding criminal procedures).

  • Evaluate, research, and prepare criminal and child welfare cases.

  • Prepare, file, and prosecute charging instruments in Tribal Court.

  • Research, develop, and institute procedures, manuals, pleading forms, prosecution plans, child welfare plans, and other needed materials.

  • Work closely with the Federal Bureau of Investigations, U.S. Department of Justice, U.S. Attorney’s Office, and other federal or state enforcement agencies to ensure that serious crimes committed on the Reservation are adequately prosecuted.

  • Recommend to the FSST Attorney General, any revisions and amendments to the Tribe’s Codes and other codes as needed for crimes and child welfare matters.

  • Assist the FSST Attorney General with public relations and legislative efforts related to drug law enforcement issues, including, but not limited to, advising committees/commissions, staff, and clients and presenting at public meetings concerning criminal and child welfare laws.

  • Advise and consult the Office of the General Attorney regarding the function and development of the tribes’ criminal justice system.

  • Advising tribal government departments, programs, committees, commissions, and other regulatory bodies as assigned.

  • Ensuring tribal businesses comply with applicable tribal, state, and federal laws as assigned.

  • Drafting legal memos, pleadings, and other correspondence as required by the Tribe and/or as assigned.

  • Identify, research, review, and advise on legal issues impacting the Tribe, its departments, programs, and businesses.

  • Present updates to the Attorney General and Executive Committee upon request.

MINIMUM QUALIFICATIONS:

  • Must be a licensed attorney in good standing with the State Bar of South Dakota, or any other state bar, and can be admitted in South Dakota within three (3) months of employment.

  • Must have between one and five years of experience as a practicing attorney, with experience in Indian Law and Criminal Law preferred.

  • Must have a juris doctorate from an American Bar Association-accredited law school.

  • No felony or misdemeanor convictions involving a crime of moral turpitude.

  • Must be able to efficiently utilize Microsoft Office and Westlaw.

  • Must have a valid driver’s license.
